RESTRICTIONS
These hardcopy or digital maps ("maps")are intended for the use of, and may be reproduced by or for the benefit of, only those individuals or entities who have purchased these maps directly from Hopkins Map Service Company, LLC. None of these maps, or copies thereof, shall be subsequently copied, sold, traded or given to any individuals or entities without the express written consent of Hopkins Map Service Company, LLC.
LIMITED WARRANTY
These maps have been compiled carefully from public and private sources; however, neither James L. Hopkins nor Hopkins Map Service Company, LLC (collectively "Hopkins") make any warranty, either expressed or implied, as to the accuracy contained herein. Hopkins does warrant that the maps or software physical diskette or CD ("media") ordered will be in good physical condition at the time of purchase or receipt from Hopkins. In the event of notification within thirty days of purchase or receipt of physical defects, Hopkins will replace the defective map(s) or media. This warranty is in lieu of all other warranties. The remedy for breach of this warranty shall be limited to replacement of the map or media and shall not encompass any other damages. HOPKINS SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL HOPKINS BE LIABLE FOR ANY LOSS OR PROFIT OR ANY OTHER COMMERCIAL DAMAGE, INCLUDING BUT NOT LIMITED TO SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. HOPKINS FURTHER DISCLAIMS ALL LIABILITY FOR DAMAGE TO ANY COMPUTER OR EQUIPMENT ARISING FROM THE USE OF THE PRODUCT INCLUDING BUT NOT LIMITED TO ANY LOSS CAUSED BY ANY COMPUTER VIRUS.
GOVERNING LAW
To the extent applicable, the above warranty shall be construed, interpreted and governed by the laws of the State of New Mexico.
COPYRIGHT
Copyrights to the maps and any accompanying materials and any copies made by you remain with Hopkins Map Service Company, LLC. Unauthorized duplication of the maps constitutes copyright infringement and in the United States is punishable in a federal criminal action by a fine or imprisonment. In addition, federal civil penalties allow the recovery of actual damages based on the number of copies produced or liquidated damages of up to US$100,000 for willful copyright infringement.
